CAR ACCIDENT INSURANCE COMPENSATION

Motorists are required, as an absolute minimum, to take out a policy for their vehicle to cover against third party risks. There is no legal requirement to also cover against theft and fire although most third party policies also include this cover. This type of policy will cover any loss or damage sustained to any other person who makes a car accident insurance compensation claim where that motorist is at fault or is negligent. Third party cover does not extend to any damage or loss to the negligent insured persons vehicle however such cover can be arranged on a fully comprehensive basis which is of necessity considerably more expensive.

The majority of motorists contract for fully comprehensive cover as a way of easing their own fears and they do this even though the law does not require it. This type of insurance complies with the minimum third party cover required by law and also covers the cost of repairing any accidental damage to the car no matter who is at fault however there is a caveat here. In this type of insurance, an excess is applied so that the motorist is required to pay the first part of the bill in a car accident insurance compensation claim, typically in the amount of several hundred pounds. This is put into place in order to discourage any unnecessary or minor claims.

In regards to all forms of cover whenever a car accident insurance compensation claim is instigated then the motorist’s claims record worsens. This means that the motorist may lose a part or even the entire no claims bonus that effectively reduces the cost of the policy for safe drivers. It is however possible, for a small extra premium to insure against the loss of the no claims bonus or to protect the no claims bonus through a specific number of claims. The loss to the motorist who makes a claim may therefore consist not only of the amount of the excess but also the cost of the loss of the no claims bonus. If someone else is to blame then all losses can be claimed against the negligent third party resulting in no loss to the innocent fault free driver.

About 1 in 20 cars in the UK does not have the minimum insurance cover required by law. Unfortunately detection rates are low and the penalties that the court imposes are not high however a driver who is not insured who seriously injures another person may find themselves paying compensation a high levels for the rest of their lives.

Our solicitors operate exclusively using the no win no fee scheme. We pay compensation in full with no deductions. Our claims are totally risk free and, win or lose there is no charge. We do not ask you to fund or finance your claim as it proceeds and we only use specialist lawyers who are members of the Law Society panel of personal injury experts.
