CAR ACCIDENT LEGAL ADVICE

Car accident legal advice should only be obtained from a specialist solicitor. Road traffic compensation claims for personal injury do require the expert help of a solicitor who has experience in dealing with motor claims and can handle the technicalities involved. Your solicitor needs to show that the other party was negligent – that their behaviour on the road was below acceptable standards and that this behaviour led directly to your accident which caused the injury. Supporting evidence is often required in the form of police reports, witness statements, medical reports, location maps and drawings and technical reports.

Some accidents are caused by hit and run drivers who may or may not be insured however these drivers often remain unidentified. Drivers should have third party insurance but not all drivers involved in an accident are insured. Either way you can still make a claim through the Motor Insurers Bureau (MIB) which pays compensation to the innocent victims of road accidents when the other driver is either uninsured or is untraced. In either case an application to the MIB is complex and technical and requires specialist car accident legal advice from a solicitor experienced in dealing with MIB claims.

Once liability has been established the next step in a compensation claim will involve the assessment of damages. Judging the value of a claim is not an exact science and as such there are many things to consider. Compensation is divided into two categories known as ‘general damages’ and ‘special damages’. Special damages represents compensation for items that can be calculated with a degree of accuracy and include wages loss. Special damagers represent compensation for items that cannot be calculated accurately and require a degree of assessment and includes compensation for pain and suffering.

In assessing damages judges will listen to arguments put forward by both parties lawyers and they are entitled to refer to previously decided cases and may call upon their own experience as a practicing lawyer. In addition the Judicial Studies Board make recommendations in regards to the level of damages to be awarded for a very wide range of potential injuries.

Once the damages have been assessed our solicitor will discuss the situation with the other party in an effort to resolve the case by settlement. This means that there may be no need to go to court. Often when the liability is obvious the other solicitor will advise his or her client to accept liability and either a court can decide on the amount of damages that will be paid or a sum can be agreed upon and paid out of court.

It is wise to obtain car accident legal advice at an early stage. Our specialist personal injury solicitors deal with compensation claims on a risk free no win no fee basis and compensation is paid in full. Do yourself justice and complete the contact form and we will immediately put you in touch with a specialist solicitor. If after talking to that solicitor you decide to proceed no further you will not be charged for any advice.
