NO WIN NO FEE CRIMINAL INJURY CLAIM
In the event of a successful no win no fee criminal injury claim to the CICA our charge is 22% plus VAT, of the value of the award. This charge also includes any expenses we incur. The charge is also the
same for a successful appeal. Should your application be unsuccessful for any reason then we will not charge you a penny.
If you are applying to the CICA for
compensation, our specialists will deal with your no win no fee criminal injury claim on a risk free basis. Our experts work on the principal that the work done is only chargeable should the claim be successful. A successful claim
is one in which the applicant is awarded compensation by CICA, or by the CICA Appeals
Panel following a successful appeal. If the application is rejected then we will not
charge you. We also will not charge you if an appeal on the claim is unsuccessful. As an
applicant you are not expected to fund the appeal in any way. We do not expect you to
purchase insurance either as our claims are 100% risk free. If, after an initial
consultation, you decide not to pursue your claim then you are not obliged to do so and
you will incur no costs.
The CICA administers a compensation scheme all over mainland UK. It is a public body
and is responsible for awarding damages to innocent victims of violent crime by paying
compensation for mental trauma, physical injury and also any financial losses that result.
If the application is refused, or the award paid out is deemed inadequate, then an appeal
may be lodged. The CICA Appeals Panel deals with the appeals, and the panel is
independent of the CICA. It reviews decisions made by the CICA and may issue an award
which is binding on the CICA.
An applicant can usually ask for decisions to be re-considered and if they are refused following re-consideration an appeal can be made to the CICA Appeals Panel which must be received within 90 days of the date of the review decision by the CICA. The 90 day period may in exceptional and unusual circumstances be extended by the Appeals Panel if it would be in the interests of justice to allow a late appeal. Written notification of the outcome of the appeal, will be sent to both the appellant and to the CICA who must abide by the Appeal Panels ruling.
Applications for compensation can be rejected for a number of reasons in a criminal injury
claim :-
- failure to report the incident as soon as is reasonably possible
- any previous convictions under the Rehabilitation of Offenders Act that are not
`spent' under the terms of the act
- behaviour of the applicant, before, after and during the incident that caused the
injury
- a no win no fee criminal injury claim will fail if the applicant has not given adequate co-operation to the police
- the injury is not severe enough (the injury must last 6 weeks at least and requires
at least two appointments with a doctor)
