Insurance Fund

The Motor Insurers Bureau is a government established body with the remit of administering funds to compensate victims involved in accidents with negligent uninsured drivers or untraced hit-and-run drivers. These funds are provided by a levy on British motor insurance firms and thus represents a pool of money paid for by all vehicle users – a proportion of each individual’s motor insurance premium is effectively paid into MIB funds.

Untraced Drivers

When a claim is made that involves an uninsured driver it is handled in almost exactly the same way as an insured driver claim except that negotiation takes place with the MIB instead of with an ordinary motor insurance company. Motor Insurers Bureau regulations require a nominal excess to be deducted from the overall compensation award paid by the MIB. Claims involving an uninsured driver will usually take longer to process than those involving an insured driver because it is necessary to issue court proceedings and obtain judgement. The MIB will settle the judgement after seven days provided that they have been given correct procedural notice.

Untraced Drivers

In circumstances in which a hit-and-run accident occurs and the driver remains untraced or unidentified, a claim can be made to the MIB. There is one major difference when claiming from the MIB if the driver is unidentified or untraced; the MIB is only liable to pay nominal legal fees, plus disbursements. This is usually less than typical legal costs incurred by a solicitor in settling an MIB claim and any excess legal charges will be deducted from the damages awarded.
