The Motor Insurers Bureau is a government established body with the remit of administering funds to compensate victims involved in accidents with negligent uninsured drivers or untraced hit-and-run drivers. These funds are provided by a levy on British motor insurance firms and thus represents a pool of money paid for by all vehicle users a proportion of each individuals motor insurance premium is effectively paid into MIB funds.
UNINSURED DRIVERS
When a claim is made which involves an uninsured driver it is handled in almost exactly the same way as a claim in which the driver is insured, only that the negotiation of the settlement takes place with the MIB instead of an insurance company. MIB stipulations require a nominal excess of £300, which is deducted from the overall compensation package. Inevitably, claiming after an accident involving an uninsured driver will usually take longer to process than one in which the driver was insured, as it is likely that court proceeding will be issued to obtain judgement. The MIB will generally settle the judgement obtained after seven days if they have been given correct procedural notice.
UNTRACED DRIVERS
In circumstances in which a hit-and-run accident occurs
and the driver was untraced or unidentified, a claim can be made to the MIB for compensation for pain and suffering. Unfortunately, other losses, such
as property or vehicle damage, cannot be compensated. An appeal can be made if
you are not satisfied with the award or not satisfied with the MIBs decision
on liability. There is another difference
when claiming from the MIB if the driver is unidentified or untraced:
the MIB is only liable to pay legal fees of £175 plus VAT,
plus disbursements such as fees for medical reports. This
is usually less than typical legal costs and any excess
will be deducted from the damages awarded.
