UNINSURED DRIVER CLAIM (MIB)

The Motor Insurers Bureau operates a system of compensation based around two different processes. One is for uninsured driver claim settlements where the driver has been traced and identified and the other for untraced driver claim settlements which might otherwise be described as hit and run accidents. In order to decide which process is suitable for your particular case our solicitors begin by obtaining information :-

  • Can the other motorist be contacted by phone or in person to establish the existence or lack of a suitable insurance policy?
  • Can driver details be found in the DVLA database of registered vehicles?
  • Do the Police have any relevant details recorded in any accident report?
  • Will the other drivers insurance company be assisting in dealing with the claim?

For uninsured driver claim settlements if the driver is traced and identified then the MIB will pay compensation in the normal way, just as an insurance company would deal with such a claim, except that they require that judgement for negligence is obtained in a court of law. The MIB will thereafter settle the order for compensation made by the court and will also pay the applicants legal costs subject to deduction of a nominal excess.

If the incident is 'hit and run' with no driver traced or identified then the MIB will only pay compensation for pain and suffering together with associated losses however they will not pay all legal charges, some of which will be deducted from the amount of the award.
