MOTORCYCLE ACCIDENT
COMPENSATION CLAIM

Our specialist personal injury solicitors have substantial experience in handling motorcycle accident compensation claim settlements. Our lawyers offer cost-free legal advice and operate on a No Win No Fee basis, meaning you will not have to fund you claim in any way. If you win damages, they will be paid to you in full, so whether you win or lose, you will face no costs. Submit your details today, and an experienced advocate, a member of the Law Society Panel of personal injury experts, will respond to offer cost and obligation-free advice on how you can make a claim.

Bike riders are vulnerable road users and the number of fatalities and serious injuries increases year on year. It is in fact the negligent action of other road users — usually car drivers who do not see motorcyclists — that is often to blame for these accidents. In other cases, injuries are a consequence of defects in the highway including faulty road design, poor maintenance or obstructions that should have been cleared which may enable a motorcycle accident compensation claim against the responsible highway authority.

COMPENSATION

  • damages for loss of income in a motorcycle accident compensation claim include past and future earnings and reduced prospects for employment
  • compensation for damage to property, including vehicle repairs and insurance policy excess
  • payment for diminution in the value of a vehicle involved in an accident, resulting from the reduced value of a repaired or damaged vehicle in the market
  • costs for replacement vehicle hire or other transport costs, such as taxi fares
  • medical costs, and costs of treatment for the injury and the anticipated costs of further medicine or treatment
  • costs for personal assistance occurring subsequent to the accident, and assistance likely to be needed in the future
  • costs for pain and suffering and loss of amenity occurring as a consequence of changed or impaired lifestyle which includes costs relating to psychological conditions
  • costs of legal and other expenses occurring as a result of the claim

THE FACTS

  • 75% of accidents relate to a collision with another vehicle
  • 25% of accidents did not involve another driver
  • mechanical failure of the vehicle accounts for less than 5% of problems and tyre blowouts are usually the cause when it does
  • two-thirds of cases not involving other vehicles are because of rider error
  • highway defects account for less then 5% of injury inducing incidents
  • failure to accord appropriate right of way accounts for two-thirds of multiple vehicle collisions
  • the principal cause of collision is the failure of the motorist to see the motorcycle
  • the evidence in motorcycle accident compensation claims tend to show that most accidents occur close to where the motorcyclist set out
  • most crashes involve a car turning left in front of the oncoming motorcycle
  • accidents tend to frequently occur at junctions, when vehicles fail to accord correct right of way or motorists ignore traffic signals
  • adverse weather causes less than 5% of incidents
  • riders involved in accidents tend to be young – from 16 to 24 years old and female motorcyclists are substantially over-represented
  • in about half of cases of multiple vehicle collisions, the view of the motorcycle is obstructed
  • more severe injuries tended to occur when large displacement motorcycles were involved
  • more conspicuous motorcycles, such as those with fairings and windshields, are under-represented in statistics reporting motorcycle accidents
  • severe injury is more likely when alcohol is a factor, excessive speed is involved, or a large motorcycle is being ridden

If you have been injured in an accident within the last three years, do yourself justice and complete the contact form or phone the advice line and we will immediately put you in touch with a specialist solicitor.
