Legal aid is no longer available for general personal injury claims arising out of an accident although it is still available for qualifying applicants in medical negligence claims. Other currently available methods of financing cases include before the event (BTE) insurance which is often an add on to motor insurance and is occasionally included in household policies, private legal aid schemes which are sometimes administered by trades unions, private funding and the no win no fee compensation claim scheme (technically called a 'conditonal fee agreement' {CFA}).
Some trades unions operate what is effectively a private Legal Aid fund and will indemnify their members against legal costs and expenses however many trades unions have now abandoned their funding arrangements preferring to recommend their members to see a private solicitor on a CFA basis, which removes any liabilty that a Union may potentially have for payment of legal costs.
A no win no fee compensation claim is facilitated by the CFA which is entered into by the client and by the lawyer. Under a CFA the lawyer is only entitled to be paid his legal fees if he wins the case and those fees are usually paid by a third party insurer and not by the client. There are many variations of a CFA and the clients of some legal firms will be disadvantaged compared with the clients of other legal firms and may be at risk of paying for disbursements including medical reports and court fees. Our conditional fee agreements provide for full payment of compensation with no deductions and there is no need to fund or finance the claim as it proceeds. Before the event (BTE) insurance is a policy taken out, usually as an add on, to another insurance policy, most often a policy of motor insurance or occasionaly a household policy. If this insurance is in existence then the insurer will refer their client to a lawyer and will indemnify that lawyer and the client against all potential legal costs. In these circumstances there is no need to enter into a CFA.
