PTSD STRESS DEPRESSION COMPENSATION
Psychiatric illness comes in many forms and lawyers find themselves pursuing two main areas of compensation relating to stress, depression and anxiety caused by the working environment and as a result of ‘post traumatic stress disorder’ (PTSD) usually caused by exposure to a life threatening incident such as a road traffic accident involving fatalities although this condition can occur as a result of much less serious accidents if the claimant perceived that the were in great danger and at risk of severe injury or death. It is also possible to make a psychiatric illness compensation claim in certain restricted circumstances when someone suffers fatal injuries in proximity to the claimant without the claimant actually being in danger. If a potential claimant suffers from a recognised medical condition then a psychiatric injury compensation claim can be made against a negligent third party.

Stress at Work
The law regarding psychiatric illness compensation for stress, depression and anxiety caused by the workplace environment has developed slowly over the last 20 years and has gradually refined to the point where it is necessary to prove that the employer was aware (or should with reasonable diligence have been aware) of the claimants propensity to a psychiatric illness as a result of pressure at work and has failed to adequately protect that person from danger by ensuring that they remained in the same situation without taking active steps to reduce the risk to health. Failure by an employer to take care of the health and safety of an employee in this situation can result in a successful psychiatric illness compensation claim.

Post Traumatic Stress Disorder
PTSD is a similar complaint to that condition first documented amongst soldiers in the trenches in the First World War attributed to ‘shell shock’. If, as a result of exposure to (usually) a life threatening incident the claimant develops a recognisable psychiatric illness (often PTSD) manifesting itself by stress, anxiety and depression then it is possible to make a claim for compensation for personal injury. PTSD often occurs amongst people who have been involved in a serious road traffic accident but may have little other physical injury. A psychiatric illness compensation claim can succeed even in cases where there is no physical injury whatsoever although the existence of physical injury does strengthen the case.
