County Courts are located in the bulk of the UK’s major cities and deal with civil as opposed to criminal matters. They tend to handle cases involving modest sums, with sums of higher value dealt with elsewhere. As a rule-of-thumb, if the value of a personal injury claim exceeds £1,000 it will be dealt with in the mainstream County Court; if it less than £1,000, it is likely to be handled by the Small Claims Court which is substantially different from an ordinary court - procedures are straightforward and clear and the atmosphere is relatively informal. Staff and judges try to dispense justice without the intimidating atmosphere of other legal apparatus.
If you need advice on procedure some assistance is available directly from court staff, although there are restrictions on how far they can go. Furthermore, it may be a mistake to make a direct approach intending to issue proceedings with the Small Claims Court, without taking legal advice, as doing so effectively limits compensation to a maximum of £1000 when even minor injuries can result in settlements that are significantly higher. Note too that if a case involves a complicated area of law, difficult evidence or other unusual circumstances then at the Judge’s discretion it can be transferred to a higher tribunal.
Given the plausibility of these difficulties it is therefore advisable to seek advice from experienced personal injury solicitors. To make sure you have fair recompense for your injuries, it may be helpful to avoid the restriction involved in pursuing a claim in the lower court if appropriate. To talk to a specialist personal injury solicitor simply send the contact form or call the helpline number. If you decide, for any reason not to pursue your claim that is not a problem and you will be under no obligations and will not face any costs.
