Spine Injury Claims in the UK
Every year, more than 500 new SCI patients are admitted to specialist centres. This number does not account for SCI patients with less serious injuries who are admitted to a General Hospital for treatment. The most common causes of SCI are falls and road accidents each representing around 40% of the total. A small significant percentage is the result of violent crime including gunshot wounds. There are times when the SCI was caused by the negligence of a third party. In those cases, a spine injury claim can be instigated against the negligent third party who is liable for compensating the victim for their injuries. These are the most common types of spinal cord injuries :-
- compression – caused by pressure on the brain
- laceration – the tearing of nerve fibres
- severing – a complete break
- contusion – bruising of the spinal cord
Disabilities Caused by SCI
SCIs can result in disability. The extent of the disability depends on the severity of the injury and whether or not the injury was complete. The amount of compensation awarded in a spine injury claim depends on the severity of the injuries and the long term consequences :-
Complete SCI: A complete SCI results in the complete loss of sensory and motor functions below the level of the injury. Rarely does a Complete SCI actually result in total severing of the spinal cord. Rather, the loss of function is typically caused by bruising, a contusion or inadequate blood flow. Nearly 50% of SCIs are complete. The first 24 hours after a spinal cord injury are critical. Only 3% of SCI victims will show improvement within the first 24 hours. It is very rare for a victim to show any improvement after the first 24 hours.
Incomplete SCI: With an incomplete SCI, a few different factors affect the degree of the disability. The ability of the brain to communicate with the rest of the body will depend on how many nerves were damaged. The victim's resulting physical condition also depends on which of the vertebrae were damaged. The closer the injury is to the brain, the more function and feeling that will be lost.
